    How was it successfully argued that Microsoft has a monopoly when they only deal in software when Apple has a monopoly in both hardware and software and has gone untouched.

    The only thing Apple has a monopoly on is neatly packaged “Smug”.

    Easy. Apple doesn’t have a horizontal monopoly since it’s a bit player in the PC market and only has a significant share of the mp3 and smartphone markets. TONS of competition (mostly from MS, who trounces Apple on volume) means they don’t have a monopoly. You can’t argue a vertical monopoly either since there does exist third party alternatives for virtually everything besides the OS.

    Anyway, the question wasn’t whether or not MS had a monopoly since they did have a mostly natural monopoly (unlike utilities, which have a unnatural monopoly). The cases were over whether or not they ABUSED that status. Having a monopoly status means you can’t do some things the rest of us still can. It helps to maintain competition which is vital to both the economy and to the companies (anyone who thinks Intel would be where it is now without AMD nipping at their heels doesn’t understand basic economics).
